The client is responsible for ensuring that materials supplied to Dev Creators do not infringe the rights of any third party.

Delays in providing required information, feedback, approvals, or access may affect project timelines.

Content and Client Materials

The client retains ownership of materials they provide to Dev Creators, subject to the applicable project agreement.

The client grants Dev Creators permission to use those materials only as reasonably necessary to provide the agreed services.

The client represents that they have the necessary rights, licenses, permissions, and authority to provide those materials.

Dev Creators is not responsible for legal claims arising from client-supplied content that infringes third-party rights.

Design, Development and Revisions

The number of revisions included in a project will depend on the agreed scope.

Reasonable revisions within the agreed scope may be included.

Significant changes to:

Approved designs;

Features;

Technology;

may be considered additional work.

Additional work may require a revised quotation and timeline.

SEO Disclaimer

However, Dev Creators does not guarantee:

A specific Google ranking;
A specific search position;
A specific amount of website traffic;
A specific number of leads;
A specific revenue level;
A specific time to achieve rankings.

Search engine algorithms, competitors, market conditions, user behavior, and other external factors can affect SEO results.

No ethical SEO provider can guarantee permanent first-page or first-position rankings.

Digital Marketing Disclaimer

Clients are responsible for reviewing AI-generated outputs where human verification is necessary.

Clients should not use AI-generated outputs as a substitute for professional legal, medical, financial, safety, or other regulated advice unless appropriately reviewed by a qualified professional.

Where AI solutions process personal information, the client and Dev Creators will follow the applicable project agreement and relevant privacy and data protection requirements.

WhatsApp and Social Media Integrations

WhatsApp AI, Facebook, Instagram, LinkedIn, Messenger, and other social-media integrations may depend on third-party APIs and platform policies.

Availability and functionality may change based on the relevant platform.

Clients are responsible for complying with the applicable platform’s:

Terms of service;
Business policies;
Messaging policies;
Advertising policies;
Privacy requirements;
Consent requirements.

Dev Creators is not responsible for account suspension, API restrictions, policy changes, or service interruptions caused by third-party platforms.

Intellectual Property

Unless otherwise stated in a written agreement:

Dev Creators retains ownership of its:

Pre-existing code;
Frameworks;
Libraries;
Reusable components;
Development methodologies;
Templates;
Internal tools;
Systems;

Proprietary materials.

Upon receipt of full payment, ownership or usage rights for specifically commissioned deliverables will be transferred or licensed according to the applicable project agreement.

Third-party software, plugins, themes, fonts, APIs, open-source components, and licensed assets remain subject to their respective licenses.

Open-Source Software

Projects may use open-source software and libraries where appropriate.

Such software remains subject to its applicable open-source license.

Clients agree to comply with applicable license conditions associated with third-party open-source components included in their project.

Portfolio and Marketing Rights

Unless otherwise agreed in writing, Dev Creators may display completed public-facing projects, screenshots, logos, or descriptions of work in its portfolio, website, social media, presentations, or marketing materials.

If a client requires confidentiality or does not want the project publicly displayed, this should be agreed in writing before publication.

Dev Creators will not intentionally disclose confidential information solely for promotional purposes.

Confidentiality

Both parties may receive confidential information during a project.

Each party agrees to take reasonable steps to protect confidential information and use it only for legitimate purposes related to the business relationship.

Confidential information does not generally include information that:

Clients are responsible for maintaining appropriate credentials, access controls, hosting security, third-party accounts, and security practices after delivery where these responsibilities fall under their control.

Project Delays

Estimated timelines depend on:

Timely client feedback;
Availability of required content;
Approval of designs;
Access to required systems;
Third-party services;
Payment schedules;
Scope stability;
Technical requirements.

Delays caused by client dependencies, third-party services, force majeure events, or significant scope changes may result in revised delivery dates.

Acceptance and Launch

The client is responsible for reviewing deliverables and providing timely feedback.

Once a deliverable is approved or accepted, subsequent changes may be treated as additional work if they fall outside the agreed scope.

Where appropriate, final deployment may require:

Final approval;
Final payment;
Domain/hosting access;
Production credentials;
Third-party service configuration.

Maintenance and Support

Maintenance and support are included only where specified in the applicable agreement.

Support may include:

Cancellation and Termination

If a client terminates a project after work has started:

Fees for completed work may remain payable;

Non-refundable third-party costs may remain payable;
Work already completed may be delivered according to the applicable agreement;
Deposits or advance payments may be treated according to the agreed cancellation terms.

Dev Creators may suspend or terminate services where there is:

Non-payment;
Material breach of these terms;
Fraudulent activity;
Illegal activity;
Abuse of our team;
Security threats;
Repeated violation of agreed project requirements.

Refunds

Refund eligibility depends on the applicable service agreement, quotation, payment terms, and work already performed.

Unless expressly agreed otherwise, fees for completed work, purchased third-party services, licenses, subscriptions, advertising expenditure, or non-refundable external costs may not be refundable.

Any specific refund policy communicated in a signed agreement will take precedence for that project.

Limitation of Liability
